If the legal jargon is to much to wade through, you can read an excellent article on compliance here: How to Comply with the CAN-SPAM Act of 2003.&lt;br /&gt;&lt;br /&gt;Some of the very basic protections you should have in place are as follows:&lt;br /&gt;&lt;br /&gt;Always require double opt-in to your list&lt;br /&gt;&lt;br /&gt;Always make opting-out of your list easy&lt;br /&gt;&lt;br /&gt;Be willing to manually remove subscribers if they have trouble unsubscribing on their own&lt;br /&gt;&lt;br /&gt;Include language in each mailing reminding your subscribers of the opt-in nature of the list&lt;br /&gt;&lt;br /&gt;Your next task is to beat the spam filters. A lot of consumers use anti-spam software to filter out unwanted e-mail messages. You should let subscribers know (either on site or within the first autoresponse message) that your messages could be blocked by their filters, and they should place your domain on their "white list" to avoid any problems.&lt;br /&gt;&lt;br /&gt;It is especially important to educate your AOL subscribers as well. You have a list of hungry subscribers at your fingertips and now you need to convert them into customers. You want to send them the best offer possible, presented in the best possible light.&lt;br /&gt;&lt;br /&gt;In order to accomplish this, you need to create effective sales copy.&lt;br /&gt;&lt;br /&gt;Good copy includes many elements: voice and style, proper grammar, spelling and punctuation, emphasis on benefits and much more. Let's talk a bit about each of these.&lt;br /&gt;&lt;br /&gt;Voice/Style&lt;br /&gt;&lt;br /&gt;Your messages should sound professional without sounding "stuffy".&lt;br /&gt;&lt;br /&gt;You need to find your unique voice to connect with your subscribers. Pretend that you are sitting across the table from a friend and write as if you were speaking to them (leaving out, of course, things like swear words or references to your personal life).&lt;br /&gt;&lt;br /&gt;You should also keep close watch over pronoun usage. Talk directly to the subscriber and avoid using the word "I" as much as possible. Be personable, but not too personal.&lt;br /&gt;&lt;br /&gt;English 101&lt;br /&gt;&lt;br /&gt;We all make mistakes in our writing at times. Your subscribers will probably forgive you for a few gaffes. However, you don't want to send out horribly written messages. Always run your copy through a spell-checker. Brush up on your grammar and punctuation skills if you've gotten rusty.&lt;br /&gt;&lt;br /&gt;Focus on Benefits&lt;br /&gt;&lt;br /&gt;Never place your focus on selling the product or its features alone. People want to know what the product can do for them. For example: will it save them time? Will it save them money?  Will it bring more love into their life?&lt;br /&gt;&lt;br /&gt;Remember that most consumers, even if they swear otherwise, purchase products that they desire, and not products they need. Self-gratification and self-improvement always lay behind the buying impulse.&lt;br /&gt;&lt;br /&gt;Offer Useful Content First&lt;br /&gt;&lt;br /&gt;Are you giving your subscribers useful information?  You need to win them over first with lots of high quality, free content before you begin making offers. Your sales pitches should be periodic in nature.&lt;br /&gt;&lt;br /&gt;It’s a really bad idea to flood your list with offers every single day of the week. If you want, you can bury an affiliate link or two in each newsletter as long as it points to a useful resource in the context of your content. Just go easy on the special offers, though.&lt;br /&gt;&lt;br /&gt;The best way to prime your subscribers is through scarcity. Your offers should be something subscribers look forward to receiving, rather than something easily predictable.&lt;br /&gt;&lt;br /&gt;Calls to Action&lt;br /&gt;&lt;br /&gt;When you do finally send an offer to your list, don't be shy about letting your subscribers know what action you want them to take. If you're spending money to generate traffic, you want to do everything possible to ensure that traffic isn't wasted. This means getting more bang for your buck by convincing more visitors to subscribe to your list.&lt;br /&gt;&lt;br /&gt;In other words, conversion improves your return on investment and limits the temptation of spending more money on more traffic.&lt;br /&gt;&lt;br /&gt;If your opt-in list isn't converting as well you expected, there are several target elements you can experiment with to improve your opt-in rates:&lt;br /&gt;&lt;br /&gt;1. Web Copy&lt;br /&gt;&lt;br /&gt;Is the copy on your site effective?  Poorly written copy is one of the first culprits to investigate. Start by evaluating your headline. Is it enticing? Does it pull the reader in? A boring headline can cause people to click away without even reading the rest of the page. Check your main copy as well.&lt;br /&gt;&lt;br /&gt;Do you explain the benefits of list membership? People always want to know what's in it for them. Make sure you offer them plenty of reasons to sign up.&lt;br /&gt;&lt;br /&gt;2. Incentives&lt;br /&gt;&lt;br /&gt;Incentives provide additional benefits and additional reasons to join your list. If you aren't doing so already, offer a unique course, e-book or piece of software for free as a bonus to subscribers. Many times this will convert hesitant visitors into subscribers.&lt;br /&gt;&lt;br /&gt;People love freebies and they also can't resist satisfying their curiosity.&lt;br /&gt;&lt;br /&gt;3. Make it easy to join&lt;br /&gt;&lt;br /&gt;Have you placed your subscription box in a prominent place on the page? Some list owners always place their subscription box at the top of the page, while others place it at the very bottom. Either position can work well, but if you have a lot of copy to wade through, you might consider placing the box within the body copy at logical points. Make it as clear as possible that you are offering them valuable information for free.&lt;br /&gt;&lt;br /&gt;If your copy is too much of a sales pitch and short on benefits, the visitor will have a hard time finding a compelling reason to subscribe. People are wary of hype these days and too much focus on the "buy my product!" mindset raises a lot of suspicion. There is just one more step for you to take before your product is "complete" :protecting your work.&lt;br /&gt;&lt;br /&gt;There is a lot of confusion and misinformation out there concerning intellectual property and copyright. There are also quite a few unscrupulous people who would have no problem stealing your product and passing it off as their own.&lt;br /&gt;&lt;br /&gt;One place where this happens frequently is on Ebay. Sellers (granted, some mistakenly) take information products which do not have resale rights attached to them and put them up for sale.&lt;br /&gt;&lt;br /&gt;It is rare to see someone go so far as to steal your entire sales page and product, but I have seen it occur on a few occasions. Usually, a stern warning or a cease and desist letter from an attorney will suffice.&lt;br /&gt;&lt;br /&gt;However, you'll want more protection for your work if you have to go to court. Also, it is just a good idea generally to copyright your work. It is something to be proud of and you enjoy numerous benefits as the holder of copyright.&lt;br /&gt;&lt;br /&gt;Copyrighting E-Books and Digital Products&lt;br /&gt;&lt;br /&gt;The first thing you need to know is that an e-book, piece of software, image or audio/video file is considered, by the law, to be a digital work. Any work published and distributed digitally falls under this domain. Technically, a digital work is not considered a new category under the law.&lt;br /&gt;&lt;br /&gt;Further, there is still a lot of discussion in the legal arena about the limits of fair use in terms of a consumer's right to print or distribute a digital work.&lt;br /&gt;&lt;br /&gt;If at all possible, I would suggest that you file a traditional application for copyright in addition to an application to copyright a digital format of your work. This means you should print out your books, put your media on cd, etc. and mail in these 'hard copies' to apply for a regular copyright.&lt;br /&gt;&lt;br /&gt;The reason is that the laws protecting digital work actually vary across jurisdictions. This has to do with how the works are classified in these jurisdictions.&lt;br /&gt;&lt;br /&gt;For example, a multimedia work is considered non-composite (not containing multiple copyrightable entities) in most jurisdictions. Yet, a computer game (which obviously includes text, images, music and more) is considered a composite work. The laws don't always follow common sense.&lt;br /&gt;&lt;br /&gt;We will stick to the subject of e-books for the rest of our discussion on copyright.&lt;br /&gt;&lt;br /&gt;Regardless of what format your work takes, it is always a good idea to consult an attorney. You may also want to check out some books at the library to familiarize yourself with the basics of the law.&lt;br /&gt;&lt;br /&gt;Copyrighting E-Books&lt;br /&gt;&lt;br /&gt;The U.S. Copyright Office offers a wealth of information which will assist you in obtaining your very first copyright. Take some time to browse through the site and read the section on literary works. This is the category under which you'll file for copyright.&lt;br /&gt;&lt;br /&gt;The term "literary", in this case, refers both to fiction and non-fiction, though it doesn't sound like it. Don't worry, though - your e-book is considered a literary work even if you aren't Shakespeare!&lt;br /&gt;&lt;br /&gt;The form you will file will be either Form TX or Short Form TX. Here are the basic guidelines for which one to use and when:&lt;br /&gt;&lt;br /&gt;Short Form TX&lt;br /&gt;&lt;br /&gt;· You are the only author and copyright owner of this work, and&lt;br /&gt;&lt;br /&gt;· The work was not made for hire, and&lt;br /&gt;&lt;br /&gt;· The work is completely new (does not contain a substantial amount of material that has been previously published or registered or is in the public domain)&lt;br /&gt;&lt;br /&gt;We can infer that, for every other case, you need to use Form TX. If you follow my product creation formula using public domain material (a very popular approach these days), you'll definitely file with the short form.&lt;br /&gt;&lt;br /&gt;Two Types of Works&lt;br /&gt;&lt;br /&gt;Did you know you have more than one option for how you class your work? You can file a copyright for each product you create or you can file a copyright on collected works. A collected work is a category which contains multiple works copyrighted within one entity. For example, songwriters and poets can copyright multiple works at a time this way.&lt;br /&gt;&lt;br /&gt;Each song or poem enjoys protection under the master copyright. So, you could follow this method and create, say, "The Collected Works of Joe Marketer" - under which would fall your individual product titles.&lt;br /&gt;&lt;br /&gt;The advantage of doing it this way is mostly about time and cost savings. You only file one form and pay one fee to copyright multiple works at a time. You will then file as usual each time you want to add to the collection.&lt;br /&gt;&lt;br /&gt;What You'll Need When You File&lt;br /&gt;&lt;br /&gt;There are a couple of elements you'll need to pull together into the package you mail off. You'll need a $30 non-refundable filing fee. You'll need a completed Form TX or Short Form TX; and, you'll need at least one full copy of the work(s) to be copyrighted.&lt;br /&gt;&lt;br /&gt;Unpublished works require only one copy. If you are filing a work which includes public domain material in its creation, you may need copies of that material as well as additional copies of your original work. Check with the office or with an attorney to be sure.&lt;br /&gt;&lt;br /&gt;As far as format goes, you can send you work in on standard printer paper or on whichever media represents your intended distribution method for the work. Use printed, paper copies for e-books.&lt;br /&gt;&lt;br /&gt;You will tie all of this together into a large envelope and mail it off to:&lt;br /&gt;&lt;br /&gt;Library of Congress Copyright Office 101 Independence Avenue, S.E. PDF is the more commonly used of the two. However, there is a lot more you can do with EXE files.&lt;br /&gt;&lt;br /&gt;You can place multimedia, flash and other elements into EXE files. So, why don't people use them?  There are two reasons: first, a lot of people online have been trained to be wary of executable files - using PDF is just a matter of making the customer feel safe. The second reason: Mac users. Mac users can't open Windows EXE files. PDF is the alternative that allows you to reach every user in the market.&lt;br /&gt;&lt;br /&gt;Creating a PDF document is fairly easy. You can use a standard editor like MS Word. All you do after that is run the document through a converter to get your PDF file. We aren't covering any special 'tricks' or marketing insights. Instead, we're on the hunt for content.&lt;br /&gt;&lt;br /&gt;No content = no product.&lt;br /&gt;&lt;br /&gt;Sourcing Content&lt;br /&gt;&lt;br /&gt;The quickest and cheapest way to source content is to go into the public domain. Before we discuss public domain requirements, here is a short list of sites to add to your favorites:&lt;br /&gt;&lt;br /&gt;http://www.archive.org/&lt;br /&gt;http://www.creativecommons.org/&lt;br /&gt;http://www.promo.net/pg/&lt;br /&gt;http://www.blackmask.com/&lt;br /&gt;&lt;br /&gt;So, what can you find in the public domain? Anything!&lt;br /&gt;&lt;br /&gt;You'll find texts, audio, images, stock video, software and everything under the sun. A large portion of this material is "fair use", but be forewarned that not all of it is free of copyright protection. At Creative Commons, for example, there are new works being entered under a public license, so there will be some restrictions on those works.&lt;br /&gt;&lt;br /&gt;Let's talk about 'fair use' for a moment.&lt;br /&gt;&lt;br /&gt;The Fair Use Doctrine was not a part of the original copyright law, but was drafted through numerous court decisions and finally codified in Section 107 of the copyright law. This establishes the rights of other to work with copyrighted material. It's important to be aware of this because you need to understand the rights granted to you by the public domain and the limitations you might encounter if the copyright status of a work you find is in question.&lt;br /&gt;&lt;br /&gt;Not all of the works entered into the public domain database are free and clear of restrictions.&lt;br /&gt;&lt;br /&gt;Here are 'four factors to be considered in determining whether the use of a work is far', according to the law:&lt;br /&gt;&lt;br /&gt;1. The purpose and character of the use, including whether such use is of commercial nature or is for nonprofit educational purposes;&lt;br /&gt;&lt;br /&gt;2. The nature of the copyrighted work;&lt;br /&gt;&lt;br /&gt;3. Amount and substantiality of the portion used in relation to the copyrighted work as a whole; and&lt;br /&gt;&lt;br /&gt;4. The effect of the use upon the potential market for or value of the copyrighted work.&lt;br /&gt;&lt;br /&gt;These guidelines will assist you if any work you encounter during your search happens to have some restrictions on it - or if you find that you need additional content and can't find anything in the public domain to fill in the gaps.&lt;br /&gt;&lt;br /&gt;It's best to just bypass anything that isn't fully public domain, but I've included this here in case you encounter a unique case during your search.&lt;br /&gt;&lt;br /&gt;Now, for the definition of public domain - you'll find that many sites refer to materials as "primarily public domain". This is legal maneuvering which is intended to give a nod to the possible restrictions we mentioned before. A true public domain work is information open to the public for free use, including copying, distributing and modification free of charge.&lt;br /&gt;&lt;br /&gt;When do works pass into the public domain?&lt;br /&gt;&lt;br /&gt;Currently, works published seventy-five years ago are considered to be public domain. Works published from 1924-1963 may be public domain if the copyright was not renewed. Anything else should be considered protected under the law.&lt;br /&gt;&lt;br /&gt;What can you do with public domain material? Anything! You can claim entire texts, reformat them and publish them as e-books. You can use public domain texts as bonuses. You can build web sites and products around them. For example, take a look at www.scienceofgettingrich.net.&lt;br /&gt;&lt;br /&gt;This entire site was based upon the public domain work by Wallace Wattles called "The Science of Getting Rich". It has spawned a plethora of copycat marketers who went out and find additional public domain works related to the subject of prosperity and new age manifestation techniques.&lt;br /&gt;&lt;br /&gt;I recommend hitting the major archives I listed at the beginning of this lesson during your first search.&lt;br /&gt;&lt;br /&gt;There is a lot to wade through at these sites and you'll be wise to familiarize yourself with the navigation, search functions and general availability of subjects.&lt;br /&gt;&lt;br /&gt;If you can't find exactly what you're looking for at the above sites, then you can use a Google search to ferret out more resources. Essentially, all keyword data tells you is what people are searching for and with what frequency. This does indicate existing markets, but it doesn't tell you exactly how hot that market is, or give you an idea of the types of products being purchased...&lt;br /&gt;&lt;br /&gt;A much better place to look is in the trade and special interest magazines you find right on the shelf at your local bookstore.&lt;br /&gt;&lt;br /&gt;Generating Ideas: A Case Study&lt;br /&gt;&lt;br /&gt;I have in my hands right now an art magazine called "Expressions"...&lt;br /&gt;&lt;br /&gt;Each issue of Expressions covers a handful of crafts project, and features top notch artists teaching their trade. At the back of the magazine are the mail order advertisements. You can learn a lot by browsing through these.&lt;br /&gt;&lt;br /&gt;For example, there is an ad here for pre-made stamps.&lt;br /&gt;&lt;br /&gt;This ad has run in every issue of Expressions for the last year. Obviously, the merchant must be doing very well in this niche and pulling enough revenue to keep on advertising. This is a hot market - as are all the other craft supply niches. However, we can also say that "how to" art information is a hot market as well.&lt;br /&gt;&lt;br /&gt;What type of craft project product could we create?&lt;br /&gt;&lt;br /&gt;Well, let's take a look and see what's already out there in the public domain. If we find enough material, we'll have a product in no time. We're going to let the product come to us by browsing for content and thinking of ways to piece it together.&lt;br /&gt;&lt;br /&gt;My first step takes me over to a search for "art" on Archive.Org. Wow! There are dozens of results here, including books, screensavers and freeware. As I scroll down the page, I see something that catches my eye: "Do-It-Yourself Sand Brownies Craft Kit".&lt;br /&gt;&lt;br /&gt;Something like this would be perfect to turn into a product. I could bundle this with an e-book on using sand in craftwork (which I would find via public domain or by hiring out someone to write it for me), or I could look for similar "Do It Yourself" kits on this site and compile all of them into an e-book I'd title "Ten Great Do It Yourself Crafts for Kids".&lt;br /&gt;&lt;br /&gt;Now, that was easy wasn't it?&lt;br /&gt;&lt;br /&gt;This is one way of approaching product creation. Let the idea come to you as you browse through general public domain content sites. You can generate your ideas and create you product at the same time simply by making use of what's on hand.&lt;br /&gt;&lt;br /&gt;If you're a bit pickier than this, then another approach is to come up with your idea prior to content sourcing and then going out and searching for the relevant content.&lt;br /&gt;&lt;br /&gt;I find this, at times, to be a bit harder to do. It is much easier to create a product by spinning off ideas from what you have in your hands than by getting your heart set on one idea and struggling to make the available content to conform to it.&lt;br /&gt;&lt;br /&gt;You might not encounter this problem if your chosen niche falls into a broad or popular category, however.&lt;br /&gt;&lt;br /&gt;Essentially, almost anything you can think of can be turned into a product. All you need to do is start thinking in terms of value. You might be wondering how to place value on a product you didn't create from scratch, especially if you employ public domain material.
